This notice applies to HIBIKI-operated websites, subdomains, accounts, games, applications, digital products, learning services, support services and official online communities that link to it. A product or service may provide an additional privacy notice where its processing differs materially.
Third-party marketplaces, social networks and platforms process information under their own privacy notices when they act as independent controllers.
2. Personal information we collect
Depending on how you interact with us, we may collect:
Identity and contact information - Name, username, account identifier, email address, postal address, telephone number and communication preferences.
Account and authentication information - Login details, account status, security records, password reset information and identifiers received from an authentication provider.
Transaction and subscription information - Products purchased, order number, price, billing status, subscription status, invoices, tax information, refunds and payment-provider transaction identifiers.
Payment card information is collected directly through Stripe's payment infrastructure. HIBIKI does not store complete payment-card numbers or security codes.
Support and communications - Support tickets, emails, live-chat messages, feedback, survey responses, call notes and files or screenshots you provide.
Technical and usage information - IP address, device and browser type, operating system, language, approximate location derived from IP, timestamps, referral information, pages or functions used, crash reports and diagnostic logs.
Game, application and service information - Account progress, entitlements, settings, achievements, moderation records, session information and saved data.
Community and user-content information - Profile information, posts, messages, reports, moderation actions and content you submit to HIBIKI-operated community spaces.
Business and professional information - Company, role, project details, contractual communications and supplier or client records.
Marketing information - Marketing permissions, suppression records, campaign interactions and preferences.
Information from other sources - Payment providers, authentication services, marketplaces, distribution platforms, anti-fraud services, professional advisers and publicly available sources.

4. How we share information
We share personal information only where we have a lawful basis. Recipients may include:
Service providers and processors who act on our instructions (payment processing, hosting, analytics, email delivery, support tools).
Professional advisers and regulators where required or appropriate.
A buyer or prospective buyer in a business transfer, subject to confidentiality arrangements.
Law enforcement, courts or public authorities where we have a legal obligation or lawful request.
We do not sell personal information. We do not share personal information for third-party cross-context behavioural advertising unless we have your consent where required.
5. International transfers
Where we transfer personal information to a country outside the UK or EEA that does not have an adequacy decision, we put in place standard contractual clauses or another recognised transfer mechanism. You may request a copy of the relevant safeguards by contacting privacy@hibiki.co.uk.
6. Data retention
We keep personal information only as long as necessary for the purpose it was collected, subject to legal retention periods. Typical retention periods are:
Account information: until the account is deleted, plus a reasonable period to comply with legal obligations.
Transaction records: retained for up to 7 years after the relevant tax year.
Support records: retained for up to 3 years after the last contact.
Technical logs: retained for up to 12 months.
Marketing preferences: until consent is withdrawn or the account is inactive for 3 years.
7. Your rights
Under applicable data protection law, you have rights including:
Access - to request a copy of the personal information we hold about you.
Rectification - to ask us to correct inaccurate or incomplete information.
Erasure - to request deletion of your personal information where the law permits.
Restriction - to ask us to limit processing in certain circumstances.

Non-essential technologies must not be enabled merely because you continue browsing.
4. Categories
Strictly necessary
These technologies are required for core functions such as security, authentication, shopping baskets, payment flow, network management, fraud prevention, load balancing and remembering a privacy choice. They cannot normally be switched off through our consent tool where their use is legally exempt, although you may be able to block them in your browser. Blocking them may prevent the service from working.
Preferences and functionality
These remember optional choices or provide enhanced features. Depending on the purpose and legal exception available, we may request consent before using them.
Analytics and service measurement
These help us understand service performance, diagnose problems and improve content. We will request consent where required.
Advertising and cross-service tracking
These may profile interests, measure advertising or track activity across services. We will not use them without consent where consent is required.
5. Your choices
When you first visit, our consent interface provides an Accept optional cookies choice, a Reject optional cookies choice with comparable prominence, and a way to choose categories or purposes.
You can change or withdraw your choice at any time using the Cookie settings link displayed in the website footer or consent interface. Withdrawing consent does not affect use that occurred lawfully before withdrawal.

7. Third-party content
A third-party embed may allow its provider to store or access information. Where consent is required, the embed should remain blocked until you consent. After activation, the third party may act as an independent controller under its own privacy and cookie information.
8. Browser and device controls
Most browsers allow you to block or delete cookies. Device or application settings may provide similar controls. Browser-level blocking may not control every similar technology and may make parts of a service unavailable.
9. Do Not Track and universal signals
Browser "Do Not Track" signals are not implemented consistently. Where the law or an applicable recognised standard requires us to honour a browser or device signal, we will do so.
10. Personal information

Digital Content Remedies Policy

1. About this policy
This policy explains cancellation rights and remedies for digital content purchased directly from HIBIKI ENTERTAINMENT LIMITED.
HIBIKI, we, us and our mean HIBIKI ENTERTAINMENT LIMITED, company number 11462598, whose registered office is Unit 29 Highcroft Industrial Estate, Enterprise Road, Waterlooville, England, PO8 0BT.
This policy applies to consumers who purchase digital content directly from a HIBIKI-operated website or service. It should be read with our Terms of Service.
Nothing in this policy excludes or restricts any right or remedy that cannot lawfully be excluded under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or other applicable law.
2. What this policy covers
This policy covers digital content supplied directly by HIBIKI, including downloadable digital assets, files, software, game content, templates, learning materials and similar electronically supplied products.
It does not govern purchases made from the Unity Asset Store or another third-party marketplace, bespoke services supplied under a separate agreement, physical goods, or business-to-business purchases where a separate written agreement applies.
3. Your 14-day cancellation right
Where you are a consumer and buy digital content online, you will normally have a legal right to cancel the contract within 14 days after the contract is made.
Where you ask us to make digital content available during the 14-day cancellation period, we will ask you, before supply begins, to expressly consent to immediate supply and expressly acknowledge that you will lose your cancellation right once supply begins.
Once supply begins following valid consent and acknowledgement, you will no longer have the statutory 14-day cancellation right for that digital content. This does not affect your rights if the content is faulty, not as described or otherwise does not conform to the contract.
4. How to cancel before supply begins
To cancel before supply begins, contact HIBIKI support through support@hibiki.co.uk and provide your name, the email address used for the order, the order number or other proof of purchase, and a clear statement that you wish to cancel.
Where cancellation is valid, we will reimburse sums due without undue delay and normally within 14 days after being informed of the cancellation.
5. Your rights when digital content is faulty
Digital content supplied to a consumer must be of satisfactory quality, fit for a particular purpose made known to us, and as described.
Where digital content does not conform to the contract, you may be entitled to repair or replacement, and where that is not possible, an appropriate price reduction (up to the full price).
Where digital content supplied by us damages your device or other digital content because we failed to use reasonable care and skill, you may be entitled to repair or appropriate compensation as provided by law.
6. Compatibility and technical requirements
Before purchase, please review the product description, version information, dependencies and stated hardware or software requirements.
A change-of-mind refund will not ordinarily be offered after valid immediate-supply consent where the product description accurately disclosed its compatibility requirements. This does not limit your rights where our compatibility information was inaccurate or the content is faulty.
7. Subscriptions
Where digital content is supplied through a subscription, the price, billing interval, minimum term, renewal arrangement and cancellation method will be shown before purchase. Cancellation stops future renewals but does not ordinarily create a refund for a period already supplied, unless required by law or expressly offered.
8. How to request a remedy
Contact HIBIKI support at support@hibiki.co.uk and provide your name and contact details, order number or proof of purchase, product name and version, relevant device or software information, a clear description of the problem, and any relevant screenshots or logs.
We aim to acknowledge requests promptly and provide an initial substantive response within 14 days. Complex technical investigations may take longer, but we will keep you informed.
9. Governing law
These terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the United Kingdom or another country, you retain any mandatory protections given to you by the law of your home jurisdiction.

1. About these terms
These Terms of Service govern your use of HIBIKI-operated websites, accounts, applications, games, digital products, learning services, support services and official online communities that link to these terms.
HIBIKI, we, us and our mean HIBIKI ENTERTAINMENT LIMITED, company number 11462598, whose registered office is Unit 29 Highcroft Industrial Estate, Enterprise Road, Waterlooville, England, PO8 0BT.
You and your mean the person using a HIBIKI service or purchasing directly from us.
By creating an account, purchasing a product or service, or using a HIBIKI service, you agree to these terms where they apply to that activity.
Additional terms may apply to a particular product, game, subscription, service, promotion or community. Where additional terms conflict with these general terms, the more specific terms will apply to that product or service.
Nothing in these terms excludes or restricts any right or remedy that cannot lawfully be excluded or restricted.
2. Our services
HIBIKI develops and provides digital products and services which may include:
games and interactive entertainment;
software, tools, plugins and digital assets;
educational and learning materials;
websites and online applications;
subscriptions and account-based services;
support and documentation;
community and communication features; and
professional or business services.
The particular features, compatibility requirements, licence terms, price and availability of a product or service will be described on the relevant product or service page where applicable.
Some HIBIKI products are distributed through third-party marketplaces or platforms. Purchases made through a third party may also be governed by that platform's terms, payment arrangements and refund procedures.
3. Accounts
Some services require a HIBIKI account.
You must provide accurate information where requested and keep information that is relevant to your account reasonably up to date.
You are responsible for taking reasonable steps to protect your account credentials and authentication methods. You must not knowingly allow another person to use your account where the relevant service or licence does not permit account sharing.
If you believe your account has been compromised, contact HIBIKI Support as soon as reasonably possible.
We may require additional authentication or security checks where reasonably necessary to protect an account, our services or other users.
4. Purchases and digital content
Where you purchase directly from HIBIKI, the price and main characteristics of the product or service will be displayed before you place your order.
Additional information relevant to compatibility, functionality, subscriptions, licences or technical requirements may be provided on the applicable product page.
For digital content supplied directly to consumers, cancellation rights and remedies are explained in our Digital Content Remedies Policy.
Where you ask us to supply digital content during a statutory cancellation period, we may ask you to expressly consent to immediate supply and acknowledge any resulting loss of your statutory cancellation right before supply begins.
Nothing in these terms limits your statutory rights in relation to digital content or services that are faulty, not as described or otherwise do not conform to the contract.
5. Subscriptions
Some HIBIKI services may be offered as subscriptions.
Before entering into a subscription, we will provide the applicable price, billing interval, any minimum term, material renewal information and available cancellation method.
Unless stated otherwise before purchase, cancelling a subscription prevents future renewals but does not automatically entitle you to a refund for a subscription period that has already been supplied.
Any statutory cancellation, cooling-off or refund rights applicable to your subscription remain unaffected.
We will operate subscriptions in accordance with the consumer law applicable to the contract, including applicable requirements concerning pre-contract information, renewal, reminders, cancellation and cooling-off rights.
6. Licences and intellectual property
HIBIKI and its licensors retain ownership of their intellectual property rights in HIBIKI products and services, including software, source and object code, graphics, designs, documentation, text, audio, video, trademarks and other protected material.
Purchasing or accessing digital content does not transfer ownership of the underlying intellectual property to you.
Instead, where applicable, you receive a licence to use the content in accordance with the licence terms supplied with the product or service.
Different products may have different licence terms. For example, a software tool, game, educational resource and downloadable asset may permit different forms of use, modification or redistribution.
Unless the applicable licence expressly permits it, you must not:
reproduce, distribute, sell or commercially exploit HIBIKI content beyond the rights granted to you;
remove or alter copyright, trademark or proprietary notices;
make HIBIKI software, assets or paid materials available to others in a way that substitutes for their own lawful purchase or licence; or
claim ownership of HIBIKI intellectual property.
Nothing in these terms prevents any use permitted by applicable law that cannot lawfully be restricted by contract.
7. Acceptable use
You must use HIBIKI services lawfully and must not deliberately interfere with their normal operation or the rights of other people.
You must not use our services to:
commit, encourage or facilitate unlawful activity;
infringe another person's intellectual property, privacy or other legal rights;
knowingly distribute malware, malicious code or material designed to damage or improperly access systems or data;
gain or attempt to gain unauthorised access to accounts, systems or restricted areas;
impersonate another person or materially misrepresent your identity where doing so could cause harm or facilitate abuse;
send unlawful unsolicited marketing or spam through our systems;
harass, threaten or abuse other users or HIBIKI staff;
circumvent technical restrictions, security controls or access controls without authorisation; or
deliberately disrupt, overload or impair a HIBIKI service.
Reasonable security research, interoperability, testing or other activity permitted by law is not prohibited merely because it involves technical investigation.
8. Community and user content
Some HIBIKI services may allow users to post, upload or otherwise submit content.
You retain ownership of intellectual property rights you hold in your content.
By submitting content to a HIBIKI service, you give us a non-exclusive licence to host, store, reproduce, display and technically process that content to the extent reasonably necessary to operate, secure, moderate and provide the relevant service.
You must have the rights necessary to submit the content and grant us that licence.
We may restrict access to or remove user content where we reasonably believe this is necessary to enforce these terms, comply with law, protect users or third parties, maintain service security, or operate our moderation policies.
Where applicable, additional community or game rules may explain moderation standards, reporting processes and enforcement measures.
9. Online safety and moderation
Where a HIBIKI service includes user-to-user features, we may use proportionate moderation, reporting, access controls and other safety measures appropriate to that service.
We may investigate reports and take action including warnings, content restrictions, temporary suspensions or account restrictions where reasonably necessary.
Where a service falls within applicable online-safety legislation, we will operate that service in accordance with the duties applicable to it.
10. Third-party services
HIBIKI services may link to, integrate with or depend on third-party services such as payment providers, authentication providers, marketplaces, hosting providers or community platforms.
Third-party services may be governed by their own terms and privacy information.
We are not responsible for the independent operation of a third-party service merely because we link to or integrate with it. This does not affect any responsibility HIBIKI has under law for services that we ourselves have agreed to provide.
Purchases made through third-party marketplaces, including the Unity Asset Store or another distribution platform, are also subject to the marketplace's applicable purchase, licence and refund arrangements.
11. Service availability and changes
We aim to provide our services with reasonable care and skill.
Online services may occasionally be unavailable because of maintenance, security incidents, technical failures, updates, third-party outages or circumstances outside our reasonable control.
We may modify, update or discontinue features where reasonably necessary, including for security, technical, legal or product-development reasons.
Where a material change adversely affects a paid service you are currently entitled to receive, we will take reasonable steps to provide appropriate notice where practicable and will respect any rights or remedies you have under applicable law.
We do not use this section to exclude responsibility for failing to provide a service as required by law or by our contract with you.
12. Suspension and termination
You may stop using a HIBIKI service at any time, subject to any applicable subscription, licence or contractual terms.
We may restrict, suspend or terminate access where reasonably necessary because:
you materially or repeatedly breach these terms or applicable product rules;
we reasonably believe an account or service is being used unlawfully or fraudulently;
your use creates a material security risk or risk of harm to HIBIKI, another user or a third party;
we are required to do so by law or a competent authority; or
the relevant service is being discontinued.
Where appropriate, we will provide reasonable notice and an opportunity to address the issue before termination. We may act immediately where there are serious security, legal, fraud, abuse or safety grounds.
Termination does not remove rights or liabilities that arose before termination.
Where we terminate or discontinue a paid consumer service for reasons that are not attributable to your breach, your entitlement to any refund or other remedy will be determined by the contract and applicable law.
13. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.
We are not responsible for loss or damage that was not reasonably foreseeable when the contract was made.
Unless expressly agreed otherwise, products and services supplied to consumers are provided for personal and non-commercial use. We are not responsible under a consumer contract for business losses such as loss of profit, revenue, business opportunity or business interruption.
If you use a HIBIKI product or service for business purposes, additional business or product-specific terms may apply.
Nothing in this section affects any remedy that cannot lawfully be excluded or restricted.
14. Privacy and cookies
Our Privacy Notice explains how we collect and use personal information.
Our Cookie and Similar Technologies Notice explains how cookies and similar storage or access technologies are used and how you can manage your choices.
These notices form part of HIBIKI's legal information but do not reduce the rights provided to you by applicable data protection or privacy law.
15. Changes to these terms
We may update these terms to reflect changes to our services, technology, business practices or legal and regulatory requirements.
The latest version will display its effective date.
Where a change materially affects an existing paid service or materially changes your rights or obligations, we will provide reasonable notice where required or appropriate.
Changes will not retrospectively remove rights that you have already acquired under an existing contract unless the law permits the change and the contractual basis for making it is fair.
If a change requires your consent under applicable law, we will ask for that consent.
16. Complaints and support
If you experience a problem with a HIBIKI product or service, please contact HIBIKI Support.
For a problem involving a purchase, include sufficient information for us to identify the transaction and understand the issue, such as your order number, account email address, product name and a description of the problem.
Nothing in our support or complaints process prevents you from exercising any statutory right or remedy available to you.
17. Governing law and courts
These terms and contracts between you and HIBIKI are governed by the law of England and Wales.
If you are a consumer resident in Scotland or Northern Ireland, you retain any mandatory protections available to you under the law applicable in your part of the United Kingdom and may have the right to bring proceedings in your local courts.
If you are a consumer resident outside the United Kingdom, you may also retain mandatory consumer protections provided by the law of your country of residence.
If you are acting in the course of a business and no separate written agreement states otherwise, the courts of England and Wales will have exclusive jurisdiction.
18. General terms
If a court or competent authority determines that part of these terms is unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A delay by us in enforcing a right does not automatically mean that we have waived that right.
These terms do not give any person other than you and HIBIKI a right to enforce them, except where applicable law provides otherwise.
Where a product or service is governed by specific licence terms or a separate written agreement, those specific terms take priority to the extent of any conflict with these general terms.
